The Bush regulations would…
Allow America’s threatened polar bears to drown in a sea of inaction by preventing the Endangered Species Act from protecting the bears from the threat of global warming; and
Let federal agencies in charge of building highways, dams and other projects decide whether those projects might drive rare plants and animals to extinction, without ever checking with the expert biologists in the U.S. Fish and Wildlife Service and National Marine Fisheries Service.

Thank you for writing me about environmental laws and administrative rule changes. I appreciate hearing your views.

Historically, presidential administrations often use a variety of tools available to them to enact policy changes during the final days of their presidencies, especially when the party in control is switching. Outgoing presidents often exercise unilateral authorities through executive orders, executive agreements, national security directives, memoranda, and other directives to speed through their policy priorities.
Your comments specifically address the influence of the Bush Administration on the environmental agency rulemaking process as it relates to the Endangered Species Act (ESA). Since President Bush acted before the end of his term, it is my understanding that the implementation of this rule has been finalized.

However, the Obama Administration is currently reviewing all late-term rulemaking and may attempt to slow or stop the implementation of rules they do not support. The President may also effectively repeal an existing rule by beginning an alternative rulemaking process. Congress is also authorized to quickly overturn rules under the Congressional Review Act, and may exercise other means of weakening rules, such as restricting funding for enforcement of the rules.
H.J. Res. 18 has been introduced by Congressman Rahall, and it would nullify the implementation of this controversial ESA modification. The resolution has been introduced and referred to the Committee on Natural Resources for review. I will carefully monitor the progress of this legislation, as well as related actions by the Obama Administration.

Weve already gained the support of some 120 members of Congress to pass federal legislation to end her barbaric killing. And we will stop her.
